Important Notice: Please read carefully before enrolling into a training course or purchasing a product. By enrolling, purchasing or paying, you agree to be bound by these Terms and Conditions.
These Terms and Conditions govern the commercial relationship between Dangerous Goods Training Centre Pty Ltd ("DGTC") and its clients. Separate policies apply in respect of student rights, conduct, privacy, complaints, and workplace health and safety. These policies are available on our website and form part of your overall agreement with us.
1. Fees and Payments of Courses for Individuals
- 1.1 Full payment is required at the time of enrolling into a course with DGTC.
- 1.2 DGTC will provide all course information so that the learner/participant is making an informed decision about the course they are enrolling into before any type of payment is taken.
- 1.3 Company Accounts – Only approved companies will be given an account with DGTC. If you have an account with DGTC, please provide a Purchase Order number to secure your booking when returning booking forms, enrolments and all other paperwork required by DGTC.
- 1.4 All payments are made online and processed securely through Stripe. Accepted payment methods are:
- Debit card
- Credit card
- Afterpay
- ZipPay
- 1.5 Your booking is confirmed once full payment has been received; for standard online bookings made through the website this happens immediately on payment. There is no separate paper enrolment form to sign and return. After booking, the learner/participant completes their enrolment online by filling in a short intake form via their student account; this should be completed before the training day.
2. Cancellation and Rescheduling of Courses
- 2.1 A learner/participant who cancels a course booking more than forty-eight (48) hours before the scheduled session start time is entitled to a full refund of the course fee, processed automatically to the original payment method. A cancellation made forty-eight (48) hours or less before the scheduled session start time is not refundable; the learner/participant may instead reschedule to another available course date, or forfeit the fee.
- 2.2 All cancellations and rescheduling must be completed online by the learner/participant via their student account on the DGTC website. It is the learner/participant's responsibility to select a new date from those currently available. Rescheduling moves the existing booking at no additional charge and may be done at any time while a future date for that course remains available.
- 2.3 If a learner/participant fails to attend their booked course without cancelling or rescheduling beforehand, no refund is payable; the learner/participant may reschedule to a future available date or forfeit the fee.
- 2.4 If a learner/participant records two (2) consecutive non-attendances ("no-shows"), the booking and all associated training fees are forfeited in full and no further rescheduling will be permitted against that payment. To attend a future course, the learner/participant must make a new booking and pay the full course fee.
- 2.5 Where a learner/participant believes exceptional circumstances apply (for example, serious medical issues or bereavement), they may submit written notice with supporting evidence to the CEO of DGTC, who has sole discretion to grant a one-off rescheduling or refund outside the conditions of clauses 2.1–2.4.
- 2.6 A course booking is personal to the named learner/participant and is not transferable. Another person cannot attend in your place, and a substitute participant cannot be nominated onto your booking. If a different person needs to attend, they must make their own separate booking and pay the relevant course fee.
3. Refunds
- 3.1 Refunds on course bookings are governed by Section 2: a cancellation more than forty-eight (48) hours before the session start is refunded in full; within forty-eight (48) hours the fee is not refundable and the remedy is to reschedule online via the student account.
- 3.2 DGTC reserves the right to refuse (without reason) a refund on products.
- 3.3 Any refund request relating to a product must be submitted in writing and you will receive a response within sixty (60) days of your written request.
- 3.4 It is the buyer's responsibility to check and review all products on purchase.
- 3.5 DGTC is not liable for damage to products once payment has been made.
- 3.6 DGTC is not liable for damage during delivery from DGTC to the address supplied by the buyer.
4. All Off-Site Courses
- 4.1 Confirmation must be signed and returned within 48 hours of booking or scheduled course date will not be held.
- 4.2 All off-site courses will be of charge.
- 4.3 NO REFUNDS will be considered if cancelled/changed within seven (7) days of the training course date.
- 4.4 Additional charges may occur if extra material/time is to be included in an on-site session.
5. Training at Dangerous Goods Training Centre
- 5.1 Late arrival on the day of your training is 100% the learner/participant's responsibility. This includes adhering to the strict session timetable (Course Information Outline) which also includes returning from breaks and lunch at the agreed time. Doors will be locked, and you will have to reschedule your session and pay the FULL training cost on the confirmed course booking you hold.
- 5.2 DGTC reserves the right to cancel, postpone or re-schedule courses/training due to low number of enrolments or unforeseen circumstances at any time.
- 5.3 All information provided by DGTC at the time of publication may be subject to change at any time. This can include but is not limited to website information, fees, dates and content.
- 5.4 DGTC reserves the right at any time to record via video or audio, place of business, learning/training sessions for quality assurance purposes, security and is not limited to specific reasons.
- 5.5 All current and past learner/participants/customers and employers will be notified where any change occurs that may affect the service that is provided to them. This includes but is not limited to:
- A change in ownership of the business
- Any changes to, or new third-party arrangements that DGTC puts in place for the delivery of services
- 5.6 DGTC has all relevant legal requirements needed for business and any changes to legislative and regulatory requirements that affect services will be updated immediately.
- 5.7 With reason and proof at any time, DGTC can request for you to pay for any damage made by yourself towards any property or item that is owned by DGTC. This is not a limited list but could include items such as: chairs, seats, signs, training centre fixtures, building fixtures, training products etc.
6. Conditions of Training Course / Assessment / Observations
- 6.1 DGTC will conduct all training/assessments/observations in a fair and equitable manner as appropriate to the course objectives, learning outcomes or competencies.
- 6.2 For all current dates and times of DGTC courses and what is involved and expected, please visit our website, or contact our office via phone or email.
7. Participants Enrolled in Training Courses
- 7.1 A learner/participant must be assessed against all the training tasks required and to be successful they must demonstrate writing and/or physical knowledge of the course they are enrolled into.
- 7.2 Learners/participants must not translate, merge, adapt or modify any part of the course including any type of documentation, training material, signage or any type of item owned by DGTC.
- 7.3 Any learner/participant who does not abide by or fails to comply with the direction of the Trainer/Assessor or DGTC employees, will have their training suspended until the entire situation has been evaluated.
- 7.4 A written report is provided to the learner/participant with the details of the incident.
8. Conditions for Re-Assessment for Dangerous Goods Licence
- 8.1 Learner/participants deemed not yet competent must be re-assessed within four (4) weeks of failed assessment at no extra charge.
- 8.2 Learner/participants that are deemed not yet competent on the second assessment must re-schedule and attend another two (2) day course and pay the relevant training fees again.
9. Guarantee
- 9.1 DGTC guarantees that we will deliver all programs/products as advertised and agreed to.
- 9.2 In the event that DGTC has to postpone or cancel a training course, meeting or event, paying participants will be entitled to one of the following:
- To participate at the revised date specified by DGTC
- A refund (if payment had already occurred)
- A credit to the agreed/paid amount for future DGTC events
- 9.3 DGTC will provide all course information so that the learner/participant is making an informed decision about the course they are enrolling into before any type of payment is taken.
10. Events Outside of Our Control
- 10.1 DGTC will not be liable or responsible for any failure to perform or delay in performance of obligations that we have offered that are caused by events outside of our control. Such circumstances will be assessed and an appropriate decision will be made; this decision will be made for all participants'/companies' best interests and safety precautions will be made efficiently.
11. Liability
- 11.1 DGTC is not liable for any event that may cause, but is not limited to:
- Loss of income
- Loss of current business contracts or profits
- Business interruption
- Loss of the use of money or current or anticipated savings (business or personal)
- Loss of information of any kind
- Loss of opportunity, goodwill or reputation
- Any indirect or consequential loss or damage of any kind
- Personal harm
- Property (not limited) including personal items, computers, mobile phones, clothing, vehicle/s
12. Products
- 12.1 DGTC reserves the right to cancel, mark a product out of stock or delete a product without reason at any time.
- 12.2 All information published by DGTC may be subject to change at any time. This can include but is not limited to website information, fees, dates, content and prices.
- 12.3 DGTC has all relevant legal requirements needed for business and any changes to legislative or regulatory requirements that affect services will be updated immediately. Please note that where a product is subject to a recall, DGTC will advise immediately, however a refund will not be given.
- 12.4 Within reason and proof at any time, DGTC can request you to pay for any damage made by yourself towards any property or item owned by DGTC. This can include but is not limited to items such as chairs, seats, signs, training centre fixtures, building fixtures, training products etc.
13. Product Guarantee
- 13.1 DGTC guarantees that we will deliver all products as advertised.
- 13.2 DGTC will provide product information so that the purchaser makes an informed decision about the product they are purchasing before any type of payment is taken.
- 13.3 DGTC stock may not be available and a wait time will be advised if this situation occurs.
14. Acceptance of Products
- 14.1 Payment of a product from DGTC is acceptance of these terms and conditions.
- 14.2 Confirmation sign-offs and an invoice are acceptance of these terms and conditions.
15. Application for a Credit Account
- 15.1 All applications will be held in strict confidence and will be handled by authorised personnel only. Should your DGTC application be accepted, you agree to pay for goods/training services within thirty (30) days of the invoice date. Failure to do so will incur a 5% penalty, plus a $25.00 Administration Fee.
- 15.2 All applications acknowledge that if any debt recovery action is commenced against accepted applications, you will be liable for all costs and commissions incurred.
- 15.3 All goods remain the property of DGTC until paid in full.
- 15.4 All training resources or licence applications may be held if payment has not been made within the 30-day account period.
- 15.5 If there are any changes to contact details or change of main contact person, approved application details are to be updated immediately by contacting the office.
- 15.6 All approved applications must agree to all of DGTC's Terms and Conditions. At any time that these may be updated, they are available on our website www.dgtc.com.au. An application for a credit account will not be approved if all terms and conditions are not adhered to.
16. Delivery and Return of Goods
- 16.1 Unless DGTC agrees in writing, GST, delivery, carriage insurance, handling, storage, packaging and any other expenses relating to the goods shall be charged to and paid by the customer.
- 16.2 In the absence of specific information/instructions from the customer, DGTC will elect the carrier and make such an agreement with the carrier on behalf of the customer.
- 16.3 DGTC will endeavour to deliver goods (or provide services) within the customer's required delivery period but subject to change, shall not in any event be liable for any loss or damage directly.
- 16.4 DGTC shall not be liable for any loss or damage resulting in any failure to give notice of any delay in delivery.
- 16.5 The customer shall be responsible for providing adequate labour and/or material handling equipment for the loading and unloading of all goods at its premises.
- 16.6 Custom goods are NOT refundable.
- 16.7 Return goods may be subject to a 10% restocking fee.
- 16.8 Return goods are to have freight PRE-PAID when returning goods to DGTC.
- 16.9 Return goods will NOT be accepted without prior arrangement with DGTC.
- 16.10 Return goods will NOT be accepted after thirty (30) days of invoice date.
- 16.11 The customer's return of goods to DGTC for credit requires a written letter asking for credit/refund. DGTC will approve or decline with a written response. DGTC has the right to decline a request for credit or a refund.
- 16.12 Where goods are being returned to DGTC, the customer MUST ensure they are returned complete with all parts, if necessary, in a safe condition, displayed in correct packaging and no marks. DGTC has the right to decline any goods that have been damaged on request for a credit/refund.
- 16.13 Where the goods or training services have been purchased incorrectly, it is at DGTC's discretion whether a credit/refund may be issued or to return the goods. The request must be in writing and a response will be given in writing. DGTC must be contacted within fourteen (14) days of purchase or booking.
17. Website
- 17.1 The website is correct at time of publication.
- 17.2 The website Terms and Conditions may change regularly, and no notice is given when they have changed. It is up to you to check back on a regular basis and confirm before purchasing a course and/or product. No liability will be incurred if you have not read these prior to booking a course or purchasing a product.
- 17.3 We are not liable for any errors or omissions.
- 17.4 DGTC endeavours to ensure that the site is up to date, however is not liable if prices/information are not correct beyond the date of publication.
- 17.5 DGTC provides links to other sites such as Government Departments where these sites are not run or affiliated with DGTC, and we are not liable for any information on their respective websites.
- 17.6 DGTC will always try to provide you with correct prices or other fees charged by Government Departments. These are a guide only; you would need to check with the relevant Department to receive the current price as we cannot guarantee that the price will remain the same when you acquire services from these departments.
- 17.7 DGTC provides links to other sites that we think will be of benefit to you/our customers but cannot guarantee correct prices and current information are applied. These links are external, and you will leave the DGTC website when viewing them.
18. Acceptance of Full Terms and Conditions
- 18.1 Payment of a product or enrolling into a DGTC course is acceptance of these terms and conditions.
- 18.2 Confirmation sign-offs are acceptance of these terms and conditions.
